0. Zero-Tolerance Policy for Objectionable Content & Abusive Users
Doctotalk hosts user-generated video content uploaded by doctors. By using the Platform you acknowledge and agree:
- The Platform has a zero-tolerance policy for objectionable content (including but not limited to: medical misinformation, harassment, hate speech, sexually explicit material, content that endangers minors, or content promoting self-harm) and for abusive users.
- You may Report any video that violates these standards from the in-app player or shorts feed. Reports are reviewed by our moderation team within 24 hours; videos that violate this policy are removed and the uploading doctor's account may be suspended or terminated.
- You may Block any doctor from the video player, shorts feed, or doctor profile screen. Blocking immediately hides that doctor's videos, shorts, saves, and watch history from your feed and search results. Manage your blocked doctors from Settings → Blocked Doctors.
- Doctors who repeatedly post objectionable content or who are blocked by a material number of users will be permanently removed from the Platform.
1. Acceptance of Terms
By accessing or using the Doctotalk platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Platform Overview
Doctotalk is a teleconsultation platform that connects patients ("Users") with licensed medical practitioners ("Doctors") for online consultations via text chat and video.
3. User Responsibilities
- Provide accurate and complete personal and medical information.
- Use the Platform solely for lawful purposes.
- Maintain the confidentiality of your account credentials.
- Not use the Platform for emergency medical situations.
- Ensure your wallet has sufficient balance before initiating a consultation.
4. Doctor Responsibilities
- Maintain valid medical registration and licensing.
- Provide professional medical advice based on information shared during consultations.
- Clearly communicate when an in-person evaluation is necessary.
- Maintain patient confidentiality.
- Not prescribe medications without adequate medical assessment.
- Sole responsibility for user-generated content: Doctors are solely responsible for any videos, captions, prescriptions, chat messages or other content they upload or send through the Platform, including ensuring it is accurate, lawful, non-misleading, and complies with the Doctor Content Rules and Medical Content Policy.
- Telemedicine Practice Guidelines, 2020: Conduct every consultation in accordance with the Telemedicine Practice Guidelines, 2020, including verifying patient identity, obtaining patient consent, exercising professional discretion to consult or refer for in-person care, and following the prescription norms applicable to teleconsultation.
- Own registration and indemnity: Maintain, at the Doctor's own cost, valid medical registration and current professional indemnity insurance. Doctotalk does not provide, arrange, or guarantee professional indemnity insurance for any Doctor.
5. Consultation and Billing Terms
- Consultations are billed on a per-minute basis at the rate set by the Doctor.
- Billing begins when both parties join the session and consent is provided.
- Charges are deducted from the User's wallet balance in real-time.
- If the wallet balance is exhausted, the session automatically ends.
- Doctors receive earnings after deduction of platform commission and applicable taxes.
6. Wallet System
- Users must recharge their wallet via the integrated payment gateway before using consultation services.
- Wallet balances are non-transferable and cannot be converted to cash except as required by law.
7. Content Removal Rights
Doctotalk reserves the right, at its sole discretion and without prior notice, to remove, hide, demote, or restrict access to any content uploaded to the Platform — including videos, captions, profile information, and chat content — that we believe in good faith violates these Terms, our Community Guidelines, our Medical Content Policy, applicable law, or any third-party rights. We may also disable or terminate the responsible account.
8. Platform Liability Limitations
- Doctotalk acts as an intermediary and does not provide medical advice or treatment.
- The Platform is not liable for medical decisions made by Doctors.
- The Platform is not a substitute for in-person medical care or emergency services.
- To the maximum extent permitted by law, the Platform is provided "as is" without warranties of any kind, and Doctotalk's aggregate liability for any claim arising out of or relating to the Platform shall not exceed the fees paid by you to Doctotalk in the 30 days preceding the event giving rise to the claim.
9. Doctor as Independent Practitioner; No Indemnity by Platform
Doctors who consult through the Platform are independent, self-employed medical practitioners. They are not employees, partners, or agents of Doctotalk, and their use of the Platform does not create any employment or principal-agent relationship.
- Doctors are solely responsible for their own clinical decisions, diagnoses, prescriptions, and the medical care they provide to Users.
- Doctors are solely responsible for maintaining valid medical registration, holding current professional indemnity insurance at their own cost, and meeting their own tax obligations.
- Doctotalk does not provide, arrange, or guarantee professional indemnity insurance for any Doctor, and is not liable for any clinical act, omission, or professional negligence of a Doctor.
- Doctotalk operates only as a technology intermediary that connects Users and Doctors, and acts as an intermediary within the meaning of the Information Technology Act, 2000.
10. Account Termination
Doctotalk reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
11. Governing Law
These Terms shall be governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in India.
