Terms of Use – Doctotalk

These Terms of Use ("Terms") constitute a legal agreement between You ("User") and Kalasvi Cares (OPC) Private Limited, having its registered office at 1-17-91, Rangachari Nagar, Armoor, Nizamabad - 503224, India ("Kalasvi Cares", "We", "Us", "Our" or "Company") and govern your use of the Doctotalk app and website (www.doctotalk.com) (collectively, the "Platform").
Accessing or using the Platform indicates your acceptance of these Terms. If you do not agree to any part of these Terms, you must stop using the Platform immediately.
1. General Terms
- These Terms form a binding agreement and incorporate any guidelines, policies, and rules posted on the Platform, including Privacy Policy, Payment & Refund Policy, and any notices provided by Kalasvi Cares.
- Kalasvi Cares may update these Terms at any time. Updates will be posted on the Platform, and continued use constitutes acceptance of the updated Terms.
- All communications via the Platform, including notifications, emails, and SMS, are deemed legally valid.
- Kalasvi Cares reserves the right to restrict, suspend, or terminate access to the Platform for any User in case of violations of these Terms, suspicious activity, or any behavior deemed harmful to the Platform or other Users.
- These Terms are governed by Indian law, with disputes subject to the jurisdiction of courts in Telangana, India.
- The Platform operates solely as a technology intermediary and does not provide medical services.
- Kalasvi Cares reserves the right to modify pricing, services, or features of the Platform at any time without prior notice.
2. Eligibility
- You confirm that you: Are at least 18 years old or using the Platform under parental/legal guardian supervision, are legally competent to enter into agreements, and are not suspended or banned from the Platform.
- Organizations, companies, or entities cannot register as individual Users.
- Users must provide accurate, current, and complete information during registration and keep this information updated.
- Account sharing is strictly prohibited. Each account is personal and non-transferable.
3. Account Creation and Security
- Users must register using valid email and phone numbers.
- You are responsible for keeping your account credentials secure. Any unauthorized access must be reported immediately.
- Kalasvi Cares is not liable for losses arising from unauthorized access due to your failure to safeguard your credentials.
- Users are solely responsible for all activities conducted through their account. Kalasvi Cares shall not be liable for any loss or damage arising from unauthorized access resulting from failure to safeguard account credentials.
4. Services Provided
4.1. Teleconsultation Services
- Users may consult with registered doctors via chat, audio, or video.
- Consultations are billed per minute, debited automatically from the User wallet.
- Calls will end automatically when wallet balance is insufficient.
- Teleconsultation has inherent limitations and may not be sufficient for accurate diagnosis or treatment in all cases. It does not replace physical medical examination where required.
- Users acknowledge that all medical decisions are taken at their own discretion and risk.
4.2. Wallet-Based Billing
- Users will be clearly informed of the per-minute consultation rate set by each doctor prior to initiating any consultation session.
- By proceeding with a consultation, Users acknowledge and agree to the applicable rate and associated charges.
- Consultation fees are determined solely by independent doctors. The Platform does not control, influence, or take responsibility for the pricing set by doctors.
- Users must maintain a positive wallet balance to continue consultations.
- Billing is conducted on a per-minute basis and starts when the doctor joins or the consultation is initiated.
- Billing continues until the consultation ends or the wallet balance becomes insufficient, at which point the session may be automatically terminated.
- The system-generated consultation duration and charges shall be final and binding.
- Wallet balance is intended for use within the Platform and may not be withdrawn, except where required by applicable law.
4.3. Doctor Public Profiles
- Users can view doctor details such as qualifications, specialties, ratings, and consultation fees. Information is provided for reference and is not a substitute for professional verification.
- Doctors available on the Platform are independent medical practitioners and are not employees, agents, or representatives of Kalasvi Cares. The Platform only facilitates interaction and does not control or influence medical advice.
4.4. Prescriptions
Doctors may provide digital prescriptions via the Platform at their sole discretion.
The platform does not guarantee the accuracy, appropriateness, or effectiveness of any prescription or treatment.
Users are solely responsible for following medical advice and seeking in-person care where necessary.
4.5. Referrals
Users may be referred to other doctors through the Platform for specialized consultations.
4.6. Support
Customer support is available via in-app chat, email, or call. Queries will be acknowledged within 48 hours and resolved within 30 days.
4.7. Medical Disclaimer
The Platform is not intended for medical emergencies. In case of emergency, Users must immediately contact a hospital or emergency service. The Company shall not be responsible for any delay in seeking appropriate care.
5. User Responsibilities
- Provide accurate medical information for proper consultation.
- Follow doctor instructions and comply with any warnings provided during consultation.
- Maintain account confidentiality and prevent unauthorized access.
- Only use the Platform for personal health purposes. Misuse may result in account termination.
- Users acknowledge that the Platform only facilitates consultation and that reliance on any advice or information obtained through the Platform is at their own risk.
6. Prohibited Conduct
Users may not:
- Upload or share content that is illegal, offensive, defamatory, obscene, or violates intellectual property rights.
- Impersonate other Users or doctors.
- Circumvent security features or engage in hacking.
- Attempt to manipulate the consultation billing system.
- Exploit, harass, or threaten any doctor, patient, or staff.
- Users shall not record, reproduce, or distribute any consultation (audio, video, or chat) without prior authorization.
- Any attempt to abuse billing systems, exploit refund policies, or engage in fraudulent transactions is strictly prohibited and may result in legal action.
- The company may remove content, restrict accounts, or take legal action for violations.
7. Payment, Refunds, and Billing
- All consultation fees are deducted per minute from the User wallet.
- Payments must be made in advance through wallet recharge.
- All payments made on the Platform are generally non-refundable.
- However, refunds may be considered in cases of verified technical failure, duplicate transactions, or other exceptional circumstances, in accordance with applicable laws.
- Refund requests must be raised within 48 hours of the transaction.
- All refund requests are subject to review and approval by the Company.
- The company is not responsible for failures, delays, or errors caused by third-party payment gateways or banking systems.
- Any fraudulent transactions, abuse of refunds, or chargebacks may result in account suspension, termination, and legal action.
8. Intellectual Property
- All content, software, branding, and materials on the Platform are the property of Kalasvi Cares.
- You may not copy, distribute, modify, or exploit Platform content without prior written consent.
- User-generated content may be used by Kalasvi Cares for operational, analytical, or promotional purposes in accordance with applicable laws and user consent where required.
9. Limitation of Liability
The Company operates solely as a technology platform that facilitates interaction between Users and independent medical practitioners. The Company does not provide medical services, advice, diagnosis, or treatment.
The Platform does not guarantee uninterrupted, timely, or error-free services.
To the maximum extent permitted by law:
- The company shall not be liable for any indirect, incidental, consequential, or special damages, including loss of health, income, or opportunity.
- The company shall not be responsible for any delay in seeking medical care or for any reliance placed on teleconsultation services..
- Total liability of Kalasvi Cares shall not exceed the amount paid by the User for the specific consultation giving rise to the claim.
10. Privacy and Data Collection
We collect data including email, phone number, profile picture, address, wallet activity, and consultation records.
Data is used to facilitate consultations, billing, and customer support.
Data handling is governed by our Privacy Policy.
11. Termination
Kalasvi Cares may terminate or suspend accounts for breach of Terms, illegal activity, or misuse.
Upon termination or suspension of an account, Users may lose access to certain features of the Platform, including the wallet and associated services.
Any remaining wallet balance shall be handled in accordance with applicable laws and the Company’s policies in force at the time.
12. Miscellaneous
- Third-party content may appear on the Platform; Kalasvi Cares is not responsible for accuracy or liability.
- These Terms form the entire agreement between User and the Company.
- If any provision is invalid, the remaining provisions remain in effect.
- Force majeure applies for events beyond control.
- The platform does not guarantee availability of any specific doctor or service at any time.
- Nothing in these Terms shall be deemed to create any partnership, joint venture, or employment relationship between Kalasvi Cares and any doctor or User.
